Concepts
Goods : movable property
Parties : Seller and Buyer jointly

Distance contract : a consumer contract concluded within the framework of a distance selling system organised for the provision of the product or service under the contract, without the simultaneous physical presence of the parties, whereby, in order to conclude the contract, the contracting parties use exclusively a means of communication between persons at a distance.
Product : goods offered on the Website and intended for sale on the Website
Entrepreneur : a person acting in the course of his profession, independent occupation or business activity
Buyer/You : the person entering into a contract by making a purchase offer through the Website
Warranty : In the case of contracts concluded between the consumer and the business (hereinafter referred to as: consumer contract) in accordance with the Civil Code,
- a guarantee for the performance of the contract, which the enterprise voluntarily undertakes for the proper performance of the contract in addition to or in the absence of its legal obligation, and
- mandatory warranty based on the law
Purchase price : the consideration paid for the goods and the provision of digital content.
Relevant legislation
The Contract is governed by the provisions of Hungarian law, and in particular the following laws apply:
- Act CLV of 1997 on Consumer Protection
- Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society
- Act V of 2013 on the Civil Code
- Government Decree 151/2003 (IX.22.) on the mandatory warranty for durable consumer goods
- Government Decree 45/2014. (II.26.) on the detailed rules of contracts between consumers and businesses
- Act CXX of 2011 on the Right to Informational Self-Determination and Freedom of Information
- Government Decree 373/2021. (VI. 30.) on the detailed rules for contracts between consumers and businesses for the sale of goods, the provision of digital content and the provision of digital services
Scope and acceptance of the GTC
The content of the contract concluded between us is determined by these General Terms and Conditions (hereinafter referred to as the “GTC”), in addition to the provisions of the applicable mandatory legal regulations. Accordingly, these GTC contain the rights and obligations of you and us, the conditions for the conclusion of the contract, the deadlines for performance, the terms of delivery and payment, the liability rules, and the conditions for exercising the right of withdrawal.
You are required to familiarize yourself with the provisions of these GTC before finalizing your order.
Language of the contract, form of the contract
The language of the contracts covered by these GTC is Hungarian.
Contracts covered by these GTC are not considered written contracts and are not filed by the Seller.
Prices
Prices are in HUF and include 27% VAT. The possibility cannot be ruled out that the Seller may modify the prices for business policy reasons. Modification of prices does not apply to contracts that have already been concluded. If the Seller has indicated the price incorrectly and an order has been received for the product, but the parties have not yet concluded a contract, the Seller shall act in accordance with the “Procedure for incorrect price” clause of the GTC.
Procedure in case of incorrect price
The following are considered to be clearly incorrectly displayed prices:
- Price 0 HUF,
- a price reduced by a discount, but incorrectly indicating the discount (e.g.: in the case of a product priced at HUF 1,000, the product is offered for HUF 500 despite indicating a 20% discount).
In the event of an incorrect price being indicated, the Seller offers the option of purchasing the product at the real price, with which information the Buyer can decide whether to order the product at the real price or cancel the order without any adverse legal consequences.
Complaints handling
The Service Provider handles complaints in accordance with its Complaints Handling Policy, which can be downloaded from the website www.vsherpa.hu .
Warranty
In the event of defective performance by the Service Provider, the customer may assert a warranty claim against the business in accordance with the provisions of the Civil Code.
Withdrawal
The buyer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which the buyer or a third party other than the carrier indicated by the buyer takes possession of the product. If the buyer wishes to exercise his right of withdrawal, he must send a clear statement of his intention to withdraw (for example, by post or electronic mail) to the following address: Warvasovszyk & Warvasovszky Kft.; 8143 Sárszentmihály, Arany János utca 16.; hello@vsherpa.hu .
For this purpose, you can also use the attached withdrawal form.
The buyer exercises his right of withdrawal within the deadline if he sends his declaration of withdrawal before the expiry of the deadline specified above. If the buyer withdraws from this contract, all consideration paid by the buyer, including the cost of transport (except for additional costs that arise because the buyer has chosen a type of transport other than the cheapest standard type of transport offered), will be refunded immediately, but at the latest within 14 days from the date of receipt of the buyer's declaration of withdrawal. The payment method used for the refund will be the same as the payment method used for the original transaction, unless the buyer has expressly agreed to use a different payment method; the buyer will not incur any additional costs as a result of using this refund method. The refund will be withheld until the Service Provider has received the product back or the customer has proven that they have returned it: whichever is earlier.
The buyer is obliged to return or hand over the product to the Service Provider without undue delay, but no later than 14 days from the date of notification of his/her withdrawal. The deadline is deemed to have been met if the product is sent before the 14-day deadline has expired. The direct cost of returning the product is borne by the buyer.
Based on the right of withdrawal, the price of the product can only be refunded if the product is returned unopened and undamaged. The Service Provider cannot refund the price of the product with opened or damaged packaging, given that the product can no longer be sold due to its special nature. If the buyer has not yet started using or consuming the products subject to the exception rule, i.e. has not yet opened the packaging directly protecting the product, he may exercise his right of withdrawal according to the general rules.

Partial invalidity
If any clause of the GTC is legally incomplete or invalid, the remaining clauses of the contract shall remain valid and the provisions of the relevant laws shall apply instead of the invalid or incorrect part.

Correction of data entry errors - Responsibility for the accuracy of the data provided
During the ordering process, you have the opportunity to modify the data you have entered before finalizing the order (by clicking the back button in the browser, the previous page will open, so the entered data can be corrected even if you have already moved to the next page). Please note that it is your responsibility to ensure that the data you have entered is entered accurately, as the product will be invoiced and delivered based on the data you have provided. Please note that an incorrectly entered e-mail address or the storage space of the mailbox may result in the lack of delivery of the confirmation and may prevent the conclusion of the contract. If the Buyer has finalized his order and discovers an error in the data provided, he must initiate the modification of his order as soon as possible. The Buyer may notify the Seller of the modification of the incorrect order by sending a letter from the e-mail address provided when ordering or by calling the Seller.
The purchase process
1. Select the Product
You can select individual products by clicking on the product menu item on the website. By clicking on individual products, you will find the product photo, description, price, product data sheet, and information on the active ingredient content and use of the products. When purchasing, you must pay the price listed on the website. The products are marked with an illustrated photo. The accessories and decorative elements shown in the photos are not part of the product, unless they are specifically highlighted in the product description. Please note that we do not assume responsibility for any typos or incorrect information!
2. Add to cart
After selecting the Product, you can place the desired order quantity in the "Cart" by clicking the "Add to Cart" button without incurring any obligation to purchase or pay, as placing the Product in the cart does not constitute an offer.
The contents of the Cart can be freely modified until the Payment is initiated, products can be removed from the Cart as desired, new products can be added to the Cart as desired, and the desired number of products can be changed.
3. View Cart
While using the website, you can check the contents of your cart at any time by clicking on the “Cart” icon at the top right of the website. Here you can remove selected products from the cart or change the quantity of the product. If you do not wish to select and add additional products to the cart, you can continue shopping by clicking the “Go to checkout” button.
4. Enter customer details
After pressing the "Go to checkout" button, you must enter your email address, and if you have a discount code, you can activate it until payment. After that, you can enter the Shipping Address with the "Next Step" button, and then after continuing with the "Next Step" button again, you can enter your "Billing Address." After pressing the "Continue to shipping" button, you can select the shipping method. After pressing the "Continue to payment" button, you can choose from the payment methods, and then after clicking the "Check order" button, you can check and modify your data.
5. Finalizing the order (making a quote)
If you are satisfied that the contents of the cart correspond to the products you wish to order and that your details are correct, you must declare by checking the small box that you have read and accept the "Terms of Use" and the "Privacy Policy". After that, you can complete your order by clicking on the "Start Payment" button. The information provided on the website does not constitute an offer to conclude a contract on the part of the Seller. In the case of orders subject to these GTC, you are considered a bidder.
By clicking the "Finalize Order" button, you expressly acknowledge that your offer is deemed to have been made and that your statement - if confirmed by the Seller in accordance with these GTC - entails a payment obligation. You are bound by your offer for a period of 48 hours. If your offer is not confirmed by the Seller within 48 hours in accordance with these general terms and conditions, you are released from your offer.
6. Order processing, conclusion of the contract
You have the option to place your order at any time. The Seller will confirm your offer by e-mail no later than the working day following the submission of your offer. The contract is concluded when the confirmation e-mail sent by the Seller becomes available to you in your email system.
Payment methods
1. Cash on delivery
For Hungarian addresses, you can pay the amount of your order to the GLS courier, or at the chosen parcel point or parcel machine, in cash or by bank card. The service is subject to a fee. The cash on delivery fee is +250 HUF.
2. Payment by bank card
You can shop conveniently and securely in our store by paying with a credit card. After ordering the selected goods, you can choose the online credit card payment method, where you can pay with your credit card through the payment service provider Shopify Payments (Stripe), which is currently considered the most secure and encrypted transaction.
All our customers have to do is select "Credit Card" when choosing their payment method, then enter the card number and expiration date on the Shopify Payments (Stripe) payment server. Stripe accepts VISA, MasterCard, American Express, and Discovers and Diners cards.
We can only accept bank cards issued for electronic use if their use is authorized by the bank that issued the card! Please check with your bank whether your card can be used for purchases made over the Internet. After a successful purchase, the payment service provider will issue an authorization number for the transaction, which you should write down or print out in full. In the event of an unsuccessful transaction, the payment service provider will provide an error message explaining the reason for the error.
When paying by bank card, you can use the following types of bank cards: VISA, MasterCard, American Express and Discovers and Diners cards.
When paying by bank card, you must enter the data that can be read from the bank card on the Stripe payment page, as follows:
- card number (13-19 digit number on the front of the card)
- Expiration date (embossed or printed on the front of the card, number in mm/yyy format)
- validation code (last three digits of the number located on the signature panel on the back of the card)
Payment is then made by pressing the pay button.
For a successful card purchase, you must:
- Please use only VISA, MasterCard, American Express, Discovers and Diners cards for payment.
- Your account should always have sufficient funds to cover the purchase value.
- Please enter the requested card details accurately.
- Make sure your card is not expired.
The payment is initiated by simply clicking the "Start Payment" button.
In case of payment by bank card, the Ltd. checks the receipt of the payment for the purchased products and only after the receipt of the exact amount does it start packaging the ordered products and handing them over to the selected shipping company, or preparing them for collection at the site. If you have noticed any problems during the payment (e.g. the internet connection has been interrupted) and are therefore unsure about the success of the payment, please contact our customer service!

Collection methods, collection fees
GLS Home Delivery
Products ordered on the website http://www.vsherpa.hu are delivered to your home by the GLS Hungary Kft. (hereinafter referred to as GLS) courier service throughout Hungary.
The delivery fee is 1,790 HUF for purchases under 20,000 HUF, and FREE for purchases over 20,000 HUF.
The ordered product will be delivered within 1-3 working days from the date of GLS dispatch. will attempt to deliver to the home address provided. The delivery deadline of 3 working days is only valid if the customer is available at the delivery address provided on the day of delivery.
To ensure successful delivery, GLS will send an SMS notification to the phone number provided when ordering on the day of delivery, including the phone number of the courier assigned to the address (SMS cannot be sent to a landline phone number).
The shipping fee allows for two delivery attempts, if the first delivery was not successful, the GLS courier will leave a written notice with the recipient. If the recipient does not report to the GLS courier service, the courier service will attempt to deliver the package again within 5 days. If delivery is still unsuccessful, the package will be returned to Warvasovszky & Warvasovszky Kft. In this case, our customer service will contact you.

GLS Parcel Point
You can also request your ordered products to be delivered to a GLS Parcel Point. There are more than 1,200 parcel machines available in more than 300 settlements across the country.
The delivery fee is 1,190 HUF for purchases under 20,000 HUF, and FREE for purchases over 20,000 HUF.
Parcel pickup is possible according to the opening hours of the selected parcel point.
Completion deadline
The general delivery period for an order is a maximum of 30 days from the date of order confirmation. In the event of a delay by the Seller, the Buyer is entitled to set an additional deadline. If the Seller fails to deliver within the additional deadline, the Buyer is entitled to withdraw from the contract.
Reservation of rights, ownership clause
If you have previously ordered a product and did not receive it upon delivery (excluding cases where you exercised your right of withdrawal), or the Product was returned to the Seller with an indication that it was not received, the Seller will make the fulfillment of the order conditional on the advance payment of the purchase price and shipping costs.
Sales abroad
The Seller does not differentiate between Buyers using the Website within Hungary and those outside the European Union. Unless otherwise provided in these GTC, the Seller ensures the delivery/receipt of the ordered products within Hungary.
The provisions of these GTC also apply to purchases outside Hungary, with the exception that, based on the provisions of the relevant regulation, a consumer, within the meaning of this point, is a consumer who is a citizen of a Member State or has a place of residence in a Member State, or a business that has a place of business in a Member State and purchases goods or uses services within the European Union exclusively for end use, or acts with such intention. A consumer is a natural person who acts for a purpose that is outside the scope of his commercial, industrial, craft or professional activity.
The language of communication and purchase is primarily Hungarian; the Seller is not obliged to communicate with the Buyer in the language of the Buyer's member state.
The Seller is not obliged to comply with any non-contractual requirements, such as labelling or sector-specific requirements, set out in the national law of the Buyer's Member State in relation to the relevant Product, or to inform the Buyer of such requirements.
Unless otherwise stated, the Seller applies Hungarian VAT to all Products.
The Buyer may exercise his rights in accordance with these GTC.
If an electronic payment solution is used, payment will be made in the currency specified by the Seller,
The Seller may withhold the delivery of the Product until it is satisfied that the payment of the Product price and the delivery fee has been successfully and fully made using the electronic payment solution (including the case where, in the case of a product paid for by bank transfer, the Buyer transfers the purchase price (delivery fee) in the currency of his/her Member State and the Seller does not receive the full amount of the purchase price due to the exchange rate, bank commissions and costs). If the Product price has not been paid in full, the Seller may call the Buyer to supplement the purchase price.
In order to deliver the Product, the Seller provides the same delivery options as Hungarian Customers to non-Hungarian Customers.
If the Customer can request the delivery of the Product to the territory of Hungary or to the territory of any other European Union member state according to the GTC, the non-Hungarian customer can also request this by any of the delivery methods specified in the GTC.
Otherwise, the Customer may request that the Product be shipped abroad at their own expense. Hungarian Customers do not have this right.
The Seller fulfills the order after payment of the shipping fee. If the Buyer does not pay the shipping fee to the Seller or does not arrange their own shipping by the pre-agreed date, the Seller will terminate the contract and refund the prepaid purchase price to the Buyer.
